Welcome to Bharat Logistix. These Terms & Conditions govern the use of our website, logistics platform, applications, shipment services, APIs, and related services. By accessing or using Bharat Logistix services, you agree to these Terms & Conditions.

1. Our Services

Bharat Logistix provides technology-enabled logistics and shipment management services, which may include pickup, transportation, delivery, shipment tracking, proof of delivery, COD handling, return shipments, driver management, and API-based logistics integrations.

Services, availability, delivery timelines, serviceable locations, and charges may vary depending on the shipment, location, customer agreement, and service selected.

2. Shipment Information

Customers, merchants, business partners, and users are responsible for providing accurate shipment information, including sender and receiver details, addresses, phone numbers, parcel description, weight, dimensions, declared value, COD amount, and any other information required to process a shipment.

Bharat Logistix shall not be responsible for delays, failed pickups, failed deliveries, additional charges, or other issues resulting from incorrect, incomplete, or misleading information.

3. Pickup & Delivery

Pickup and delivery timelines provided by Bharat Logistix are estimates unless specifically committed under a separate written agreement.

Delivery may be delayed due to circumstances including incorrect addresses, recipient unavailability, weather, traffic, operational disruptions, government restrictions, force majeure events, or circumstances beyond our reasonable control.

A shipment may be rescheduled when the sender or recipient is unavailable or when delivery cannot reasonably be completed.

4. Prohibited & Restricted Items

Users must not ship illegal, prohibited, hazardous, explosive, dangerous, stolen, counterfeit, or otherwise restricted goods through Bharat Logistix.

Customers are responsible for ensuring that their shipments comply with applicable laws and regulations.

Bharat Logistix reserves the right to refuse, hold, return, or report shipments where required by law or where prohibited or suspicious contents are identified.

5. Packaging

The sender is responsible for ensuring that goods are appropriately and securely packed for transportation unless packaging services have specifically been provided by Bharat Logistix.

Bharat Logistix may not be liable for damage caused by inadequate, inappropriate, or defective packaging.

6. Cash on Delivery (COD)

Where COD service is available, Bharat Logistix may collect the specified amount from the recipient on behalf of the merchant or business partner.

COD charges, settlement timelines, payment methods, deductions, reconciliation processes, and other commercial terms may be governed by the applicable business agreement or service plan.

7. Charges & Payments

Shipping charges may depend on factors including service type, shipment weight, dimensions, distance, location, COD value, special handling requirements, taxes, and other applicable charges.

Business customers may be subject to separately agreed pricing, billing cycles, credit terms, and payment conditions.

Applicable taxes, including GST, may be charged as required by law.

8. Tracking & Shipment Status

Bharat Logistix may provide shipment tracking and status information through its website, applications, APIs, or partner integrations.

Tracking information is based on operational scans, driver updates, system events, and integrations. Temporary delays between the physical movement of a shipment and its digital status may occur.

9. Proof of Delivery

Depending on the service, Bharat Logistix may record proof of pickup or delivery through OTP, signature, photograph, recipient confirmation, timestamp, location information, system event, or other available verification method.

Such records may be retained for operational, customer-support, compliance, dispute-resolution, and audit purposes.

10. Failed Delivery & Returns

If a shipment cannot be delivered because of recipient unavailability, incorrect information, refusal, access restrictions, or other circumstances, Bharat Logistix may attempt redelivery, reschedule the shipment, or initiate a return according to the applicable service arrangement.

Additional charges may apply to redelivery or return shipments where applicable.

11. Cancellation

Shipment cancellation may be permitted before certain stages of processing. Charges may apply where pickup, transportation, or other operational activity has already taken place.

For business integrations, cancellation rules may also be governed by the applicable agreement or API workflow.

12. Liability

Bharat Logistix will make reasonable efforts to handle shipments safely and provide services reliably.

To the extent permitted by applicable law, Bharat Logistix shall not be liable for indirect, incidental, consequential, or business losses arising from delays, incorrect customer information, prohibited goods, inadequate packaging, recipient unavailability, force majeure events, or circumstances outside our reasonable control.

Any specific compensation, insurance, declared-value protection, or liability limits may be governed by the applicable service plan or written business agreement.

13. Business & API Integrations

Businesses may integrate their systems with Bharat Logistix through APIs, webhooks, or other approved methods.

Customers are responsible for protecting their credentials, API keys, authentication information, and account access.

Unauthorized access, misuse, attempts to disrupt our systems, or use of our APIs outside permitted purposes may result in suspension or termination of access.

14. Account & Platform Usage

Users must provide accurate information and maintain the confidentiality of their account credentials.

Bharat Logistix reserves the right to suspend or restrict access where fraudulent activity, security threats, misuse, policy violations, or unlawful activities are suspected.

15. Changes to Services or Terms

We may update our services and these Terms & Conditions from time to time to reflect operational, legal, regulatory, security, or business requirements.

The latest version will be published on our website with an updated effective date.

16. Governing Law

These Terms & Conditions shall be governed by the applicable laws of India. Any disputes shall be subject to the jurisdiction specified under the applicable customer/business agreement or, where no separate agreement applies, the competent courts in the jurisdiction of Bharat Logistix's registered business operations.
